    power of attorney

    Does any body know how i can go about getting a POA for Alan, when he cant sign ?

    Tammy - You may also need a healthcare power of attorney to make medical decisions for a loved one if they are unable; I believe this is separate and in addition to a regular power of attorney - best wishes to you and your family at this time - Mark (bustedflat)

    I'm sorry that you are in this situation. Also, take my advice with a grain of salt.
    You can't get power of attorney without consent. You can go to court and be declared the guardian of someone who can't give you that authority. Also, as his wife you have a degree of authority around his affairs. Depending on what you need to do, you can talk to the hospital about what requirements they have for whatever decisions you need to make on his behalf.

    First and foremost please know that our thoughts and prayers are with you and Allen.

    I do not know the answer to your question however it is a lesson for all of us. Prepare and execute a Living Will and a Health Care Power of Attorney and distribute a copy to your family and a close friend. These forms are readily available on the internet and most office supply stores.

    What type of power of attorney are you looking for?

    To the best of my knowlege (yep studied some law and learned first hand helping others deal with estates and when my father was ill), if he is sedated he can not sign over power of attorney. Unfortuneatly is big wake up call to have will (holographig will: in your handwriting, signed (does not have to be notorized) and dated), durable power of attorney (to make medical decisions while he is ill. I wish I had better news, and prey Alan recovers.
