Great news from the Arizona Legislation. HJR2001 DENOUNCING THE ESTABLISHMENT OF NEW NATIONAL MONUMENTS IN THE STATE OF ARIZONA has passed in both the House and Senate.

It is now on the Governor's desk for her signature.

This should be no problem since she has already signed, with Senator Kyl and the 5 Republician Representatives, two letters to the President objecting to the new monuments in Arizona.

A JOINT RESOLUTION


DENOUNCING THE ESTABLISHMENT OF NEW NATIONAL MONUMENTS IN THE STATE OF ARIZONA WITHOUT FULL PUBLIC PARTICIPATION, CONSENT AND APPROVAL OF LOCAL GOVERNMENTS, THE ARIZONA LEGISLATURE, THE GOVERNOR AND CONGRESS.

Whereas, the establishment of two national monuments in Arizona by the President of the United States represents a misuse of the Antiquities Act of 1906 to set aside enormous parcels of real property. The Antiquities Act (16 United States Code sections 431, 432 and 433) grants authority to the President of the United States to establish national monuments, but the Act was intended to preserve only historical landmarks, historic and prehistoric structures and other objects of historic or scientific significance; and

Whereas, the proposed designation of two national monuments in Arizona clearly violates the spirit and letter of the Antiquities Act, which requires monument lands to "be confined to the smallest area" necessary to preserve and protect historical areas or objects; and

Whereas, the people of Arizona, the Arizona Legislature, the Governor of Arizona and the Congress of the United States have not consented or approved this designation, yet the creation of two new national monuments in Arizona could potentially have a significant economic impact on this state. Instead of working as a partner to help local communities and states define and achieve their conservation goals, the federal government dictates unilateral actions that would affect this state and exclude citizens and local governments from determining land management decisions in their communities; and

Whereas, land management and conservation efforts are best administered and managed at the local levels of government. The failure of the federal government to recognize and respect this basic tenet represents an arrogant usurpation by federal powers and a violation of states' rights.

Therefore

Be it resolved by the Legislature of the State of Arizona:

1. That the Legislature denounces the designation of two national monuments in the State of Arizona without full public participation, consent and approval of local governments, the Arizona Legislature, the Governor and the Congress of the United States.

2. That the Congress of the United States take action to prevent the designation of any national monuments in this state without full public participation, consent and approval of local governments, the Arizona Legislature, the Governor and the Congress of the United States.

3. That the Secretary of State of the State of Arizona transmit a copy of this Resolution to the President of the United States, the United States Secretary of the Interior, the President of the United States Senate, the Speaker of the United States House of Representatives and each Member of Congress from the State of Arizona.

Sometimes when we send these Action Alerts out the response is best described as.....modest. Not this time! USA-ALL offices have already received copies of letters that our members and supporters have written in support of the townspeople of Escalante. We wanted to shout out a really big THANK YOU to those who already have written.
To those of you who haven't written yet, I've just received the SUWA action alert regarding the Wide Hollow reservoir. Here's what "Utah's Largest Conservation Organization" is telling their members:
BLM recently re-issued the EA for the proposed Wide Hollow dam and reservoir. Unfortunately, the "new and improved" EA is not much
different than the initial half-baked EA BLM released last year for the same proposed project. Last time around, your letters helped convince BLM that the proposal and the agency's EA were stinkers.
There's more: They use the phrase "giant reservoir"and claim that "The proposed reservoir's capacity is nearly three times the unofficial "determined demand" for irrigation water, by our calculations. By their calculations indeed! This crowd has no shame!
Our supporters in Escalante say that the BLM has received quite a few public comments in opposition to the reservoir. If you haven't written a letter yet, please consider doing so. Below we've printed a couple of the best letters we've received to help you craft your own.
You have to have your letter postmarked by April 3rd, 2000 so do not delay!

The purpose of this letter is to express my support for construction of the proposed Wide Hollow dam above Escalante Utah. I understand that objective analysis of the several options to replacement of the city’s reservoir has concluded that this new construction is the most reasonable action to address the problem.
I am a frequent visitor to Escalante and environs. I rely upon the community for services and I have personal friends there. I am concerned about the viability of that community and the livelihoods of the people that represent the significant local culture based substantially on agriculture. I believe that this culture and local economy are as valuable as any resource in the surrounding area. As such, all necessary steps should be taken to insure their continued survival and well being.
I understand that special interest groups are aligned against your decision and the best interests of the citizens of Escalante. Inflammatory and intentionally misleading rhetoric, expelled in great excess should have no bearing on your decision. Pursuant to FLPMA, you have an obligation to manage the public lands in a manner consistent with federal law to the extent that those local plans do not violate or contravene that law. There is no law against construction of the new dam as proposed. There are only considerations that must be had before construction begins.
I trust that your exhaustive analysis has encompassed those considerations and that the new dam will proceed providing all reasonable allowance for the avoidance of unnecessary and undue degradation of other environmental values in addition to the values of public health, community viability and the preservation of local custom and culture.
As necessary, please forward this letter to Lorraine Pope or Marietta Eaton.

Please help...

I have found that my radiator is leaking. It appears the I have a green
dusty residue around most of the joints on it. It really isn't losing too
much water, I haven't had to fill it or top it off in over two months and it
looks pretty full.

However, being one to fix a problem before a major problem presents itself I
would like advice on what type of radiator to replace ti with.

I have heard and would like to know what reasons there would be for going 4
core, 3 core, aluminum etc...

So what ever your preference let er rip and give me your reasons on what
would be the best radiator.

Might help if I tell you it is a 97 TJ with a 2.5, 5 speed, 2" lift with
31x10.5 tires. Oh ya it does have AC which I will run in the dead heat of
the summer.

Is it still in warranty? My 97 TJ was doing the same thing evidentally.
The only way I found out was that I had taken it in to Pitre to get my
rear main seal replaced (oil leak at the back of the engine) before my
warranty ran out. They called me and told me that my radiator was also
leaking and they'd take care of it. It looks like they just replaced
the radiator completely.

btw - I really like the work that Pitre has done for me. I bought the
TJ at Darner, but they do not do service work on Saturdays. Pitre does.

You could carry a spare radiator with you like I do. Just kidding! I have a ZJ
so I have the room to easily carry a spare. Anyway, I bought my second one
from Hawks Radiator in Mesa with the lifetime warranty. It cost about $240,
but they will keep replacing it for free. I am on my second one right now and
carry a spare (which will be replaced for free when the time comes). It isn't
that the radiators (OEM or otherwise) are bad, it's that it mounted at the end
of the subframe and experiences some twisting on the trail. After a while, the
radiators start separating at the weakest points and cracking. If I never took
the ZJ 4-wheeling, I doubt I would ever have problems with the radiator.

I'm gonna go to the couch. The Couch run is at least a 5 might qualify as a
6. A winch is not neccessary, but very advisable. Ground clearance is a
great concern, low gearing getting down the stairs is a must. Careful
driving around the hairpin thorugh the living room and formal dining has
quite a drop off on the drivers side. Then the jaunt across the hard floors
of the kitchen area into the final stretch to the couch in the family room.

Sorry to make a funny, but I will be recovering from a minor surgery this
Friday and I am jealous as the rest of you will be wheeling. Pout.

Sorry for the delayed response. Monday, 4/10 works for me.

We need to pick a meeting place. I have 2 suggestions. The first
is that everybody finds gas/snacks/etc. on their own where ever
they want and then we meet at Table Mesa Road. The second is that
everybody meets at the Circle-K on Happy Valley Road at 35th avenue.
Happy Valley Road is to Phoenix as Ina or Orange are to Tucson (I
think) - it's the last main road you hit before leaving town. The
Circle-K is about a mile west of I-17 and is kind of like the last
stop heading north out of Phoenix. This would probably be a
reasonable place for people to gas up as close to the trail head as
possible. (I think there's gas in New River and in Black Canyon
City but I'm not sure.)

Hal said he could be at Ahwatukee by 8:00-8:15. I'd guess it will
take 45-60 minutes to get across town to Happy Valley Road, 15 minutes
to gas up, etc. and another 25 minutes to get up to Table Mesa Road.
This puts the Tucsonites there 9:30-10:00. So I think we should set
the meeting time for 10:00. Does this sound ok?

I'll re-send the final details once they're agreed to.

This is a nice trip....The trail rating is 3.0 to 3.5 just smooth slick
rock....and great scenery.....a few good cracks to play in and a couple of
optional boulders..etc....its jsut a lot of fun. David O boyle from the list
is coming up from Phoenix and will lead you all to sedona.....to Broken
Arrow. I will drop him a line and have him set a meeting point for you all
too meet.

Well, I bit the bullet and ordered me up a shiny new full spool for my
D44 rear axle. I just got confirmation that it's here for me to pick
up ... I'll be picking it up this weekend. I'll update you guys/gals
when I get around to installing it in the Screamin' Chicken.

The only downside is that I need to swap ratios to install it since
it's only designed for the larger ratios (like 4.10:1 through 5:38:1,
but I can get exact ##s).

Cool, I wonder if they made it larger? Anyways, have to see what the river looks like too, last time I crossed it the water was low but keep on hearing that it varies when the dam lets the water out. The federal government wants developers and individual homebuilders in parts
of seven Arizona counties - including most of Pima - to conduct more
searches for the endangered pygmy owl before blading desert vegetation.

The U.S. Fish and Wildlife Service released the toughened owl survey
guidelines yesterday, the latest twist on an issue that has existed for well
over two years.

While local home builders and Gov. Jane Hull's office won't rule out suing
to stop the guidelines, many developers are already preparing to meet them.

The guidelines call on developers to conduct up to six surveys in two
consecutive years in suitable pygmy owl habitat surrounding Tucson's urban
area. Previously, the service had urged developers to conduct a single
survey.

"Doing the surveys is the best way to ensure that owls aren't there - that
there won't be a take," said Mike Wrigley, wildlife biologist for the
service's Phoenix office. A "take" involves harassment, injury or death of a
species, he said, adding, "Basically, they can't be affected to the point
where they're not able to survive."

Last year, surveyors for state and federal agencies found 39 adult pygmy
owls in Southern Arizona.

Tom Doucette, president of the Southern Arizona Home Builders Association,
said that ultimately the survey guidelines "absolutely will delay projects."
The delays could add to a developer's risk if engineering studies and design
work are finished only to find an owl just before construction starts.

"You have to do all the front-end work, invest in the design and pay for it
in advance," he said. "The question is, what if the survey doesn't come out
the way you had hoped?"

Wrigley said the answer would likely involve tweaking development efforts to
provide the owl with enough habitat space to thrive. He added that, so far,
"we have not eliminated or stopped any projects," although the owl is likely
to force some to be scaled back.

In the summer of 1998, when the service first proposed the guidelines, many
developers warned that these guidelines would wreak havoc on their industry.
Today, many developers have gotten ahead of the game by starting the surveys
last year and continuing them this year.

"Our consultants have been telling us that they're changing the law, and we'
re pre-empting that,'' said Yoram Levy, a project manager for developer Don
Diamond's newly approved, 726-home Mesquite Ranch project on Tucson's far
southeast side. "As long as it's fair, we're willing to work with it."

But Levy questioned the practicality of guidelines that call for the same
number of surveys on the southeast side's creosote-mesquite flats as on the
northwest side's old-growth saguaro-ironwood forest.

Hull's spokeswoman, Francie Noyes, said the guidelines will devalue land
that the state hopes to sell for development.

"We feel we are going to have to express our protest in some effective way.
We just don't know how," Noyes said.

Environmentalists lauded the guidelines, contending that the extra vigilance
will better protect the owl and its habitat.

They and wildlife service officials have long contended that one year of
surveys is not enough because owls can move their nesting and roosting sites
from year to year. Currently, federal policy recommends two years of surveys
for other raptors, such as northern goshawks and spotted owls.

"It's surprising that they went this far," said Kieran Suckling of the
Center for Biological Diversity and a frequent critic of the service.

"It has as much teeth as it can," Suckling said of the guidelines, noting
that the service doesn't have the authority to require surveys.

Service officials have repeatedly said, however, that if a developer clears
owl habitat without a survey, and authorities later find that the project
harmed an owl, the developer could be fined for violating the Endangered
Species Act.

People found guilty of "taking" an endangered species face fines of up to
$100,000 or six months in prison. A company faces a fine of up to $200,000.

The guidelines split south-central Arizona into three zones, based on the
probability of an owl's occupying a given area.

The strictest zone includes sites where owls have been seen and areas that
the federal government has declared as critical habitat for the species. The
second zone encompasses land considered suitable for pygmy owls, but where
they haven't been spotted.

The third includes areas where the owl was last seen at least several
decades ago.

The guidelines affect private, city, county and state-owned land, but not
tribal land.

The searches must be conducted by federally certified owl surveyors. They
play tape-recorded owl calls between January and June, when owls typically
defend their territory.

change.
2. Drink a cup of coffee.
3. 15 minutes later, write a check and leave with a properly maintained
vehicle.

Men:

1. Go to Autozone and write a check for $50 dollars for oil, filter,
kitty litter, hand cleaner and scented tree.

2. Discover that the used oil container is full. Instead of taking it back
to Autozone to recycle, dump in hole in back yard.

3. Open a beer and drink it.

4. Jack car up. Spend 30 minutes looking for jack stands.

5. Find jack stands under kid's pedal car.

6. In frustration, open another beer and drink it.

7. Place drain pan under engine.

8. Look for 9/16 box end wrench.

9. Give up and use crescent wrench.

10. Unscrew drain plug.

11. Drop drain plug in pan of hot oil; get hot oil on you in process.

12. Clean up.

13. Have another beer while oil is draining.

15. Give up; poke oil filter with screwdriverand twist it off.

17. Buddy shows up; finish case with him. Finish oil change tomorrow.

18. Next day, drag pan full of old oil out from underneath car.

22. Install new oil filter making sure to apply thin coat of clean oil to
gasket first.

23. Dump first quart of fresh oil into engine.

24. Remember drain plug from step 11.

25. Hurry to find drain plug in drain pan.

26. Hurry to replace drain plug before the whole quart of fresh oil drains
onto floor.

27. Slip with wrench and bang knuckles on frame.

28. Bang head on floor board in reaction.

29. Begin cussing fit.

30. Throw wrench.

31. Cuss for additional 10 minutes because wrench hit Miss December (1992)
in the
left boob.

32. Clean up; apply Band-Aid to knuckle.

33. Beer.

35. Dump in additional 4 quarts of oil.

37. Lower car from jack stands.

38. Accidentally crush one of the jack stands

39. Move car back to apply more kitty litter to fresh oil spilled> during

Leah, this is a post after i sent you the email. I also had one from my
friend that we were going to see in Safford. It appears you might know
him, Keith Orr. He has suggested that we do the run with you this
Sunday. I asked him to call me tonite as we are leaving tomorrow
mourning to get to Tucson. My wife and I are planning a couple of days
of just running around the area of Organ Pipe and Bisbee etc and the
Sunday run would work really well. Can someone give me a little better
directions for Ina and Oracle. I have only driven thru Tucson and not
stopped. Thanks for any help and looking forward to wheeling with you
