Moffat County asserts rights over roads on public lands
Associated Press
Published 01. 21. 03 at 12:14 Sierra Time

DINOSAUR, Colo. (AP) - A century-old mining law could reopen roads in
Moffat County that have been closed to drivers for years under
federal mandates.

County commissioners on Friday voted unanimously to invoke the law,
asserting rights to manage more than 1,000 acres of routes on public
lands currently managed by the U.S. government.

Dinosaur Mayor Richard Blakley said he was excited about the prospect
of again driving up to Moose Mountain, which the Bureau of Land
Management closed to motorized travel in the mid-1980s.

Blakely said residents are excited too.

''They're saying 'Hey, we can start traveling these roads again,''' he said.

Ten environmental groups, including the Colorado Environmental
Coalition, have protested the county's use of the 1866 law in this
northwestern Colorado county of 3 million acres and 13,000 people.

''I think this comes from a sagebrush rebel kind of thing. Their
desire is to think it's their land, not federal land,'' said Pete
Kolbenschlag with the Colorado Environmental Coalition.

Moffat County has pushed for years to gain more control of the 1.8
million acres of public lands within its borders. On an inventory map
released by the county, the routes over which it claims jurisdiction
range from cow paths to gravel roads that cut through Dinosaur
National Monument and more than 300,000 acres proposed for wilderness
designation.

The law used by Moffat County was repealed in 1976 when the federal
government reserved for public uses all remaining federal land not
already in forests, parks or monuments. But states and counties can
still claim a right of way if they prove that the route was
constructed before the land was reserved.

New rules published by the Bush administration in December removed a
requirement that proof be furnished in court, instead allowing claims
to be administered by the BLM.

John Husband, BLM field manager in Moffat County, said there is still
a moratorium on processing the claims.

Environmental groups and federal land managers are planning to do
their own inventories this spring of the routes claimed by Moffat
County.

They and the county would not rule out the possibility of lawsuits
over the matter.

''This is a big Western issue that affects all federal land
management agencies across the West,'' said Chas Cartwright,
superintendent of Dinosaur National Monument.

Counties in Utah and Alaska also have invoked the 1866 law to assert
rights on public land routes

"No Place Distant: Roads and Motorized Recreation on America's Public
Lands"
(Island Press, 2002, ISBN 1-55963-845-1)

Island Press recently published the first comprehensive treatment of
roads
and motorized recreation on America's public lands. The book, "No Place
Distant: Roads and Motorized Recreation on America's Public Lands," has
drawn praise from conservationists, biologists, agency officials, legal
and
policy experts, and others.

Written by Roads Scholar David Havlick, with a foreword by former U.S.
Forest Service Chief Michael Dombeck, No Place Distant combines a
personal
voice with exhaustive research to create a resource that is both
engaging
and broad-ranging, while also providing a number of useful case studies
and
references.

Havlick establishes a fundamental thesis -- that America's national
forests, national parks, wildlife refuges, and other public lands suffer
from an abundance of roads in poor condition, exacerbated by growing
motorized recreational use of snowmobiles and all-terrain vehicles.
Significantly, Havlick manages to present a realistic, inspiring case
for
road removal and regulations for motorized use that recognizes the human
players involved, the complexity of the debate, and the underlying
questions of values that dictate many management decisions.

As Joseph Sax, author of Mountains Without Handrails, notes "This is a
wonderful book, full of information and full of good ideas. Havlick
brings
a fresh perspective to the public lands His carefully collected facts
set
an agenda that will have to be reckoned with."

Conservation biologist Reed Noss comments, "Havlick's well-written book
does a splendid job of illuminating the many challenges that roads and
motorized recreation pose to our society."

No Place Distant is available directly from Island Press at
http://www.islandpress.org, from Amazon.com, or from local booksellers
in
both hardcover (ISBN 1-55963-844-3) and paperback (ISBN 1-55963-845-1).

Subject: Re: Re: Rubicon VS H2

Oops, sorry, I thought I posted my message to the Arizona Virtual JEEP Club.
Last I heard, most of us here were fanatics about Jeeps. Sure, Kia makes a
good lil sport ute (and I mean that) but you can't compare it to a Jeep. And
if I was stuck and there were 7 Jeeps and 1 Kia Sportage around, I would
first go to the Jeeps to ask for a tug. If there wasn't a Jeep around I
would be very appreciative if the Kia would help. As for the god complex, I
think our Jeeps have earned the right to be revered as offroad titans, don't
you? They are in a class by themselves and no other manufacturer has
anything comparible. Besides, every vehicle make has its fanatics. I have
Toyota truck friends that feel the same way about Toyota that some of us
feel about our Jeeps (there is NO way they want to be pulled out by a Jeep
unless there is no other choice). Oh and getting stuck can be fun, too. Ya
can't blame the Jeep for getting stuck. Anything can get stuck.

And for the record, I don't like trying to compare a Jeep to a Hummer. They
are two WAY different vehicles. I don't think the H2 is intended for
hardcore 4x4 action anyway. It's a neat rig and I personally would love to
have one, but Jeep and Hummer cover two different markets in my opinion.
Kind of like comparing a fullsize extended cab Ford 4x4 to a Jeep. Sure a
lifted full size truck can go through 4 feet of snow but it doesn't rock
crawl well.

Lastly, I've seen several stock Jeeps from the club out there wheeling. My
latest Jeep is mostly still stock and we wheel it all the time. Sorry I
don't have $40,000 right now to drop in a Corvette engine, 39 inch tires and
locked Dana 60's all around.

Oh and if anyway should get flamed it's Frank for instigating this whole
argument by posting that picture :-).

Ok, I've tried this a few times before but I was so busy at work, nothing
seemed to happen. I have a RE lift for my 97 tj and I've had this thing sitting in
my garage since October and I think I'm really ready to try and put it on. As I've
stated before, I don't have a compressor or air tools but I do have a garage
and an ok set of hand tools. I live in El Mirage/Surprise but I'm willing to travel
if somebody offers up a place. This Saturday would probably be best for me,
sometime in the morning if possible. Any and all are welcome to help out. I'll
supply cold beverages and food (read pizza and beer) if anyone is interested,
as well. Let me know. Thanks,

Mike Johnson

Mike,
This Sat. is the Table Mesa cleanup. I have air tools, welder and a place to
work. Maybe, come out to the cleanup and we can make a plan while we pick up
trash.

Mike.....just a reminder that there is a major wheelin' area cleanup out
at Table Mesa this Saturday, starting at 9:00 AM. You certainly may get
some volunteers to help on your lift but you are competing against one
of the two or three annual cleanups that the VJC folks support.

Hey, I resemble that remark! Just kidding. Best of luck. My son had to move
