Subject: Ethical Question


When we sell a part on the classified section of the web sight where does our responsibility end? I advertised some parts for sale, fully disclosing the origin of the parts and there application. The parts were in good condition, with no flaws. Am I responsible if they do not fit the vehicle that the party bought them for with out some minor modifications? I must also state that I have already agreed to refund the money, I was just curious how others in the club felt about it.

With used stuff it is customary to consider it "as is", "where is".
Buyer normally assumes all responsibility.

I myself would stretch this a bit. If someone buys something from me
and gripes later, about any little thing, I'd offer to buy it back,
assuming it has not been altered.

In my opinion, if you fully disclosed all information regarding the
parts in question. Then the party that purchased the parts or
equipment, should have been fully aware if they would not fit the
application that they needed them for. I would not refund anything
until I got the parts/equipment in question returned in the condition
that it was recieved by the party in question. They could just be
taking you for a ride.

those are the chances that you take when purchasing equipment without
knowing what exactly you need.

I don't believe so.
Ex: I recently replied to someone looking for a Sahara spare cover on
JU. The guy who wanted it and I exchanged emails several times. On
one of the last emails I noticed his sig had his vehicle listed as a
YJ, well this cover came from a TJ. I notified him it was from a TJ
and there may be a differnce. He said, don't worry just send it
anyway.
The point being, it cost me $11.50 to mail it. I sold it for $25
including shipping. If I would have to take it back I loose $11.50.
Why should I take the loss when he knew the situation? Now maybe it
didn't cost you any money but, I bet it costed you some time. Time is
money. Why should you loose out if someone else doesn't care enough
to notice.

This being said, it might be nice for you to take them back but, you
aren't obligated.

As a comparison, I'm not sure I've ever bought a part (new or used)
other than an air filter that didn't require some (minor or major)
modification in order for it to fit or function properly, regardless
of the condition of the part or what it was going on to.

Second, if you made it clear to the buyer the *intended* application,
and the parts honestly had no flaws, then I don't see a problem.

If the case is someone buying something for their jeep that was not
*specifically* designed or engineered for their jeep model, then they
are accepting that responsibility.

What is the issue at hand? As the specifics will go a long way in
deciding who is right and who is not, which I believe is a valid
question because you have asked the entire group. :)

Don't take your cases to municipal, court take them to JEEP CLUB
COURT! :)

If it is clearly stated in the ad that it will fit XYZ application and the person buying it knows and understands this, then it should be up to the person selling the item to say if they will take it back. It is my OPINION (key word) that if someone buys something that is not specifically for their application and they know it, then they should not expect to be able to return it to get their money back.

Forest Green TJ. No doors, HUGE winch on front, club stickers proudly

I spent my day @ home talking to my children about what happened .
We as a family decided it would be a good idea to make cards and letters for the people in these places. WHo need to know that every one here feels their pain and our hearts and prayers are with them.
We can't give blood for a few days but we can do this right now. It helped the kids understand about tradgieand that one small thing can make a difference to some one some where.
I encourage others to do the same. Please take a minute to draw a picture or write a note and send it .

I found myself in a deleima with what to do to pass emissions and correct the constant carb ajustments necessary to keep my 4.2 alive.
The answer turned out to be a kit made for MOPAR by HESCO. Remember Clifford performance parts for 4.2s? Well he, Jeff and Bennie at
(205) 251-1472 or e-mail Jeff at hescosc@aol.com.came up with an answer. I purchased mine thru Jim Click for less than any magazine advertized! $1750.00 with
the harmonic-balancer! I bought P5249610 for manual transmission. They make one for auto too! 7 boxes and a detailed 15 page installation
manual plus 3 page tip sheet with ph# for help lines. Well, home I went and the work began! My garage and handle tools are'nt overtly complete
but in the advertised 8-10 hrs. I was done. Now I've got (from articles in 4-wheel mag.) 160hp and 230lbs or torgue. It starts easier gets better
gas-mileage and after a visit to the motor vehicle inspector to validate my work I easily past the state emissions test and have for the last two
years. The addition of Pacesetter headers and cat-back with a Jacob's igniton pushed my output up to about 180/265 respectively. Rock crawling
on off-camber situations, this system pays in dividends. I highly recommend a try or give me a call or e-mail me for a ride/info/advice/help.

I have to agree w/Dan.....a few months ago I bought a trail rack from him....knowing full well that it came out of a TJ and would probably not fit my CJ (without modification).....and it didn't....now, I could have asked for my money back when I found it did not fit....and Dan probably would have given me my money back (giving him the benefit of the doubt).....but I knew what it was so I kept it....and thanx to some cutting and welding by Bill A., the rack fits and is very functional.......

OK, here it goes, would this be manly enough?!
1955 Willys M38A1. maunal items- brakes, steering,
turn signals, hand brake(no cables), choke, windshield
release latches, hood release latches(no thumb thingy
under the hood).
No air, no heat, no doors, no hard top, no side
mirrors, no gas gauge, no speedometer, no windshield
wipers, no horn.
Does have 8,000lbs winch, rollcage, descent seats, 5
point harness, oil gauge, temp gauge, amp gauge,
completely original drivetrain with 5:38 R&P,
extraction equipment of all types, high lift, jerry
can, wussey tire pump, spare parts, wounds from last
rollover, trace amounts of blood from last rollover
(bloody nose), twisted front fenders from tire
impacts, multiple dents from mother earth, priceless
pictures from Jon Loveless with my Jeep missing one
passenger front wheel assembly due to jumping. ( lots
of air on that one!!)
Oh yeah, I had a Toyota Corolla station wagon with
bullets holes in it! Does that count??
